All About Texas Guardianships
In Texas, a guardianship case is a legal process where a court designates a guardian to make decisions on behalf of a person called a ward who lacks the capacity to make personal, legal and financial decisions. A guardian can be an individual or an entity. Reasons for a guardianship may include:
- Minor status (under 18 and without living parents with legal custody)
- Incapacity (a physical or mental condition that prevents them from making informed decisions)
There are two main types:
- Guardian of the person: Makes personal decisions for the ward, such as where they live, their medical care, education and general welfare.
- Guardian of the estate: Manages the ward’s money, property and financial matters.
The family law court is very careful with guardianship cases in Texas because guardianship removes some of the ward’s legal rights. Texas law requires proof that:
- The person truly cannot make certain decisions independently.
- Less restrictive alternatives (like a power of attorney or supported decision–making agreement) won’t work.
Once granted, the guardian must follow strict reporting and oversight rules, including annual reports to the court.
A guardianship case is important because it legally protects a person who can’t make decisions or care for themselves. In Texas (and most states), guardianship is used when someone – often due to age, illness or disability – needs another person to make legal, medical or financial decisions for them. It matters because:
- Legal authority: Without guardianship, you may not have the right to make critical decisions on someone’s behalf, even if you’re a close family member.
- Protection from harm: Guardianship ensures the person’s health, safety and property are safeguarded from neglect, exploitation or poor decision–making.
- Access to services: Many medical facilities, banks and government agencies require proof of guardianship before releasing information or allowing someone else to act for the person.
- Court oversight: The court monitors guardians to make sure they act in the person’s best interest, adding a layer of accountability.
It’s essentially the legal bridge that ensures vulnerable people get the care and decision–making help they need – without it, there can be delays or barriers in helping them.
